1. Acceptance and Scope of Agreement
By accessing thejiblab.com, you agree to fulfill these Terms and Conditions. This agreement governs all website interaction, physical product purchases, digital streaming class consumption, and premium subscription services. If you disagree with any portion of these terms, you must cease using the platform immediately.
2. Subscription Terms and Automatic Renewals
Billing Cycles: Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of enrollment.
Automatic Renewal: All subscriptions renew automatically. Your payment method will be charged the standard recurring fee at the beginning of each billing cycle unless you cancel.
Cancellation Policy: You can cancel your subscription at any time by logging into your account dashboard or contacting customer support. To avoid being charged for the next billing cycle, you must cancel at least forty-eight (48) hours before your renewal date.
Refund Policy: Past subscription payments are non-refundable. Access to digital streaming classes continues until the end of your paid billing period following cancellation.
3. Commercial Purchases, Shipping, and Final Sale Policy
Digital Content License: Purchases of digital streaming classes grant you a non-exclusive, non-transferable, revocable license to access the video content for personal use.
Final Sale Policy: All sales of physical goods and digital products are final. We do not offer a return window, and we do not accept returns or exchanges for buyer's remorse or incorrect sizing/item selection.
Delivery Issues: If you encounter a verified delivery issue (e.g., package lost in transit by the carrier or items arriving structurally damaged), you must contact us at thejiblab@gmail.com within seven (7) days of the scheduled delivery date to qualify for a replacement or resolution.
Risk of Loss: All physical items purchased are shipped pursuant to a standard shipment contract. The risk of loss and title for these items passes to you upon our delivery to the shipping carrier.
4. Technical Streaming Requirements
Bandwidth Demands: Accessing our digital streaming classes requires a high-speed broadband internet connection. We recommend a minimum continuous download speed of 5.0 Mbps for High Definition (HD) playback.
Hardware and Software: You are solely responsible for maintaining compatible hardware devices, updated internet browsers, and operating systems capable of playing standard HTML5 video streams.
Service Disruption Disclaimers: Thejiblab.com is not responsible for video buffering, low-resolution streams, or transmission interruptions caused by your local internet service provider, network congestion, or device performance limitations. No refunds will be issued for local technical limitations.
5. Health, Safety, and Physical Liability Disclaimer
Assumption of Risk: Our streaming classes involve physical exertion. By participating, you acknowledge that you are voluntarily engaging in physical activity that carries an inherent risk of injury. You assume all risks associated with participation.
Medical Clearance: You represent that you are in good physical condition and have no medical limitations that would prevent you from safely participating in these classes. We strongly recommend consulting a physician before starting any new exercise regimen.
Release of Liability: To the maximum extent permitted by law, you hereby release, waive, and forever discharge TheJiblab, its owners, instructors, and affiliates from any and all claims, demands, or causes of action resulting from personal injury, property damage, or wrongful death sustained during or as a result of your use of our streaming classes or equipment.
6. Proprietary Intellectual Property and Content Rules
Ownership: All digital classes, streaming media, articles, images, website source code, and logos hosted on thejiblab.com are the exclusive intellectual property of TheJiblab.
Prohibited Conduct: You are strictly forbidden from scraping site data, reverse-engineering website software, recording or downloading our streaming classes, circumventing subscription paywalls, or sharing your account login credentials with third parties.
7. Limitation of Liability and Disclaimers
"As-Is" Provision: This website, its contents, products, and subscriptions are provided on an "as-is" and "as-available" basis without any express or implied warranties.
Liability Cap: To the maximum extent permitted by Colorado state law, TheJiblab shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of your use of this site or purchases shall not exceed the total amount paid by you to us during the prior twelve (12) month period.
8. Dispute Resolution and Governing Law
Jurisdiction: These terms are governed strictly by the laws of the State of Colorado, without regard to conflict of law rules.
Mandatory Arbitration: Any legal dispute, controversy, or claim arising from this agreement will be settled through binding individual arbitration in Colorado, rather than in a general court of law. You explicitly waive your right to participate in class-action lawsuits.
